Your purchase and use of products from this site is governed by the terms and conditions set out below, and as set out under Security, Copyright, and Delivery. We recommend you also read our Privacy policy. You can print the full terms and conditions by selecting the print option in the File menu of your browser.
We may at any time make changes to this site and the details displayed on it (including prices).
Due to the amount of fake and counterfeit #Proto products coming from China, we can no longer offer our all encompassing warranty service. All warranty claims must be accompanied by the original proof of purchase to enable us to help you. Failure to supply this proof will result in your claim or enquiry being denied.
TERMS & CONDITIONS OF USE
1. Prices and Payment:
The prices for goods displayed for sale on this site, are #Proto prices. Delivery may be charged in addition, and any such additional charges will be notified to you on application or on completion of an order, where they apply.
#Proto cannot accept your order until you have supplied payment details for it in full. Upon receipt of these details, we will confirm acceptance of your order by e-mail which will be sent to the e-mail address you provide on your order details. Whether or not you receive the e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.
2. Shipping:
#Proto ships via either UPS, DHL, DPD, or any other courier we chose. Other shipping options may be available for an additional fee over and above the actual shipping costs. Once a product has left our warehouse and is in the possession of the shipping company, any claims must be made directly with that shipper however we can assist with most cases.
3. Your right to cancel your order:
You may cancel your #Proto order at any stage before the goods are dispatched to you, However we reserve the right to charge for any expenses incurred in the processing of your order .If you wish to cancel your order, you can either phone us on +359878877259 or email us on office@proto-performance.com
In some cases, we may be unable to prevent your order from being dispatched to you. In this case we will arrange for your order to be collected at your convenience (see our returns and refunds policy below).
4. #Proto (Limited) Lifetime Warranty
#Proto are one of the largest manufacturers of aftermarket turbo accessories, bringing cutting edge design and the highest quality to our product line, we strive every day to bring excellence to our customers. Sometimes, things can go wrong and we want YOU the customer to know you will be looked after beyond any level of customer service you have ever experienced before. With that in mind, the #Proto (Limited) Lifetime Warranty covers only products that have been purchased directly from us, or one of our authorised distributors/dealers.
If your #Proto product fails or breaks due to a manufacturing issue or defect, we will repair or replace, at no charge to the customer at our discretion. This service will only be carried out IF the #Proto product is still in its original unchanged design condition and the item/product has not been modified or changed in anyway. The #Proto (Limited) Lifetime Warranty will not cover any damage or failure caused by; improper or incorrect installation, normal wear and tear, the normal degradation of material over time, finished colour/aesthetic appearance of the product or if the product has been exposed to the use of any Traffic Film Remover or alternative acidic cleaner (commonly used in hand car washes).
The warranty will also be invalid if the #Proto product has not been fitted to correct applications that it was designed for. Any damage to #Proto products that occur outside of the warranty can be sent in for evaluation and a quotation to repair or replace said product along with a return shipping fee. The #Proto products that are covered by our (Limited) Lifetime Warranty are to the original purchaser or owner of the #Proto item for the lifetime of that said product only. The warranty policy is NOT TRANSFEREABLE However given the quality of the product that #Proto manufacture we are confident of great longevity of your “Engineered for Performance” #Proto part.
For any warranty claim or query please contact our #Proto sales team in your region or country.
This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Supplier’s instructions, or any alteration or repair carried out without the Supplier’s approval.
Any shipping or returns to #Proto must be insured, pre-paid and include a #Proto Goods Returns Form and a copy of the original invoice or proof of purchase to allow us to better serve you. The terms and conditions to the #Proto (Limited) Lifetime Warranty policy are subject to change at any time without notice.
5. Our returns and refunds policy:
If your goods are faulty or damaged on delivery, we will exchange the product or issue a refund. Goods must be returned to #Proto in the original packaging (without being installed or used, and with all relevant seals and enclosures intact) within 30 days of receipt by the buyer. Important – returned items that are damaged in transit due to inadequate packaging may not be credited or exchange if #Proto determines that due care was not taken when packaging items for return to #Proto. Where possible, please reuse the original packaging, and please contact us if you have any questions regarding adequate packaging. This is especially important when returning larger items such as alloy tanks, intercoolers and radiators. If you are returning product due to damage that has occurred in the delivery to you then please take images showing the damage to both the packaging and the product, and send them by email to office@proto-performance.com prior to packaging the damaged item for return.
If you have ordered in error we will issue a full refund (*exclusions apply) upon return of the item(s). Goods must be returned to #Proto in original packaging (and without being installed or used and with all relevant seals and enclosures intact) within 30 days of receipt by the buyer. Return of item(s) ordered in error will be considered for a further 6 weeks but these will be subject to a 15% handling fee. Returns will not be considered after eight weeks of the buyer’s receipt of order from #Proto.
In all circumstances, any action shall be subject to the buyer producing proof of purchase and returning goods, delivery paid.
* Exclusions: Products made to specific requirements or non stock items specifically ordered are excluded.
This does not affect your statutory rights.
6. General:
We shall not be liable to you where performance of any of our obligations to you is prevented, frustrated, or impeded by reason of acts of God, war and other hostilities, civil commotion, accident, strikes, lock outs, trade disputes, acts or restraints of Government, imposition or restrictions of imports or exports, or any other cause not within the reasonable control of #Proto.
Please ensure that you have received and checked your order in full before arranging fitment or installation of parts as no liability will be accepted for any costs incurred.
Any special offers or free shipping options quoted are applicable to retail sales only, and not for trade purchases. Discounts and other offers cannot be used in conjuction with another discount or offer, unless otherwise stated.
If any part of these terms and conditions is found to be unenforceable as a matter of law, all other parts of these terms and conditions shall not be affected and shall remain in force.
We cannot guarantee that the appearance and/or colours of products shown on this site exactly reproduce the appearance and/or colours of the physical products themselves. All sizes quoted are approximate.
#Proto warrant this product against manufacturing defect but accept no liability for any loss, damage or injury arising as a consequence of installation, failure.
In these terms and conditions:-
“#Proto" is the trading name of Subaruparts Ltd, “We and Us" means #Proto either alone or together with you, as the context requires; “You" means the person ordering goods subject to these terms and conditions;
7. Mapping/Tuning
The installation of any product including but not limited to remapping may or may not void the car’s factory warranty, and it is the responsibility of customers to check this with their vehicle manufacturer. All vehicles brought for remapping will be deemed fit upon arrival. It is the responsibility of the customer to ensure that the vehicle is up to date and in good condition. It is the customers responsibility to notify their insurers of any modifications. #Proto accept no responsbility for any damages during or after a remap.
8. Cooling Products and TFL
Do not use aggressive (acidic) car cleaning products, particularly traffic film remover solutions or shampoos to clean your intercooler, radiator or oil cooler. The use of these products can damage #Proto cooling systems and invalidate your warranty – these are often found at car washes. A light, warm, soapy solution (free of harsh acidic cleaning compounds) should be used to clean you cooler and thoroughly rinsed away. We recommend that you should inspect your product on a regular basis for bent and/or crushed fins. Any bent fins should be carefully straightened to allow ambient air to pass through the core face. At the time of installing your #Proto radiator, an approved coolant must be used and added to the coolant system. Be sure you never mix coolant and always use distilled water.
